Sintem Terms of Use

These Terms of Use ("Terms") govern access to and use of the Sintem mobile application and related services.
By using Sintem, creating an account, joining a group, creating a group, accepting an invitation, enabling location sharing, activating SOS, or otherwise using application features, you confirm that you have read, understood, and agree to comply with these Terms and the Sintem Privacy Policy.
If you do not agree to these Terms, do not use Sintem.
The operator of the Sintem service is Tamerlan Sarakaev ("we", "us", "our").
1. About the Sintem service
Sintem is a family safety and location-sharing application within trusted groups. The application allows users to:
- create an account and sign in using supported sign-in methods available in the application;
- create groups or join groups by invitation;
- share location with members of a selected group;
- view the location of group members on a map;
- view location history; the retention period for history depends on the current plan;
- send and receive SOS notifications;
- receive push notifications about safety events;
- build a route to a group member's location using third-party mapping services;
- manage profile, notification settings, location sharing, and account;
- purchase, renew, change, or restore a subscription through the App Store, if paid plans are available.
We may add, change, limit, or discontinue the provision of individual Sintem features at any time if necessary for service development, legal compliance, user safety, or technical reasons.
2. Important limitation of safety features
Sintem is not an emergency, medical, rescue, private security, or law enforcement service. Sintem does not replace calling local emergency services.
SOS features are intended to notify members of your trusted group of a possible danger and help them see your location in the application. Their operation depends on internet connectivity, device permissions, battery level, notification settings, operating-system behavior, third-party notification delivery services, and the availability of our infrastructure providers' servers — factors that we do not control.
We do not guarantee that an SOS notification will be delivered, read, seen, or responded to in a timely manner. You are responsible for assessing risks and making decisions in emergency situations, including contacting competent emergency services when necessary.
3. Acceptance of the Terms and related documents
Before using certain Sintem features, you may be required to accept:
- these Terms of Use;
- the Sintem Privacy Policy;
- separate group owner consent when creating a group;
- separate join-group consent when joining a group.
We may store records that you have accepted certain versions of such documents. If we publish an updated version of the Terms of Use, Privacy Policy, or related consents that requires re-acceptance, Sintem may ask you to review the update and accept it before continuing to use the application. Until the update is accepted, continued use of Sintem may be unavailable.
This does not affect the processing of data obtained before such an update, in accordance with the Privacy Policy and applicable law.
These Terms should be read together with the Sintem Privacy Policy. In case of a conflict between these Terms and the Privacy Policy regarding the processing of personal data, the Privacy Policy takes precedence, unless otherwise required by applicable law.
4. Right to use and age restrictions
You may use Sintem only if:
- you are permitted to enter into a legally binding agreement with us under applicable law;
- if you are a minor, you use Sintem only with the permission and under the supervision of a parent, legal guardian, or other authorized adult when required by applicable law;
- you provide accurate and up-to-date information when requested for account operation or application features;
- you use Sintem only for lawful purposes and in accordance with these Terms.
Sintem is designed for family safety and trusted groups and is not intended for independent use by minors without the permission and supervision of a parent, legal guardian, or other authorized adult, if such permission is required by applicable law. Detailed terms for use of Sintem by minors, the group owner's responsibility when inviting them, and our measures upon detecting use without the required permission are described in section 8 "Privacy of minors" of the Sintem Privacy Policy.
5. Account and security
Use of Sintem may require you to create an account and sign in using a supported sign-in method available in the application.
You are responsible for:
- the security of your device and account;
- actions taken through your account, unless you have notified us of unauthorized access in a reasonable manner;
- the accuracy of profile data that you provide yourself, such as display name or avatar.
You must not:
- impersonate another person;
- use someone else's account without permission;
- transfer account access to third parties, except in cases expressly permitted by applicable law and these Terms;
- circumvent technical restrictions, security measures, or access checks.
We may refuse registration, restrict access, or close an account if we have reasonable grounds to believe that the account is being used in violation of these Terms, creates a risk to other users or the service, or if required by law.
6. Groups, invitations, and location sharing
6.1. Groups
Sintem is organized around groups. The rules for participating in one or more groups at the same time are determined by the application's features and interface.
A user may create a group and becomes its owner from the moment of creation.
The group owner may:
- invite members;
- manage group membership within available features;
- remove members, if such actions are not restricted during a limited period after SOS activation;
- leave the group, in which case the group is deleted, as you are its owner, if such action is not restricted during a limited period after SOS activation;
- manage the group plan (see section 8);
A group member may:
- join a group by invitation;
- see data available through Sintem features within the group, settings, and plan;
- manage their own location sharing and notification settings, if such settings are available;
- leave the group, if such action is not restricted during a limited period after SOS activation.
6.2. Invitations
Invitation links and QR codes provide access to a group. You should share invitations only with trusted people whom you intentionally want to add to the group.
The group owner is responsible for whom they invite and for understanding that group members may see data available through Sintem features, including location and data related to SOS.
To create a group, you must accept separate group owner consent shown in the application.
To join a group, the invited user must accept separate join-group consent shown in the application.
6.3. Location sharing
Sintem is designed for transparent location sharing within trusted groups. Group members should understand when and with whom they share their location. A complete list of data that becomes visible to group members when location sharing is enabled or SOS is active is provided in section 4 "How location sharing works" of the Sintem Privacy Policy.
Location sharing depends on your settings in the application, device permissions, group membership, current plan, and available features. If you disable location permission in device settings or in the application, some Sintem features may work incorrectly or become unavailable.
After leaving a group or disabling location sharing, new location updates are no longer transmitted to that group. Data transmitted before that point may remain visible to group members in accordance with location history settings and the current plan.
We do not control how group members use, save, copy, or disclose information that they have seen in the application or received through notifications, including outside the application (for example, screenshots, forwarding, or other saving).
7. SOS, notifications, and temporary restrictions after SOS
Sintem is not an emergency assistance service (see section "Important limitation of safety features" for details). When SOS is activated, your location and related data are transmitted to group members in accordance with application settings, system permissions, and consents you have accepted.
After SOS is activated in a group, temporary restrictions on certain actions may apply. During the period specified in the application, certain actions may be temporarily unavailable, for example:
- leaving the group, including deletion of the group by the owner;
- removing a member from the group;
- deleting an account;
- other actions, if necessary for the safety of members or prevention of abuse.
Such temporary restriction by itself does not mean that new location updates continue to be transmitted after SOS is turned off, if location sharing is disabled by you or otherwise restricted by application and device settings.
You may manage individual notification settings in the application, if such settings are available. If push notifications are disabled, you may not receive SOS and other alerts on that device.
8. Plans, subscription, and payment
Sintem may offer paid plans with different limits and features. The current composition of plans, their limits, prices, location history retention periods, and trial period terms are determined by the application interface and the App Store at the time of purchase.
If paid plans are available in Sintem, the terms of purchase, renewal, change, cancellation, and restoration of a subscription are governed by Apple App Store rules and applicable law, unless otherwise expressly stated in the application interface.
Plans apply to groups as follows:
- the plan applied to a group is determined by the active subscription of the group owner;
- plans purchased by members separately from the group do not affect the limits and features of that group;
- only the group owner may change the group plan;
- if the subscription is inactive or the number of members exceeds the plan limit, access for individual members or features may be restricted.
Payments are processed by Apple. We do not store bank card data. Refunds, cancellations, plan changes, and purchase restoration are generally carried out through the App Store in accordance with Apple's rules.
We may change plans, limits, feature availability, and prices in the future. Such changes do not apply to an already paid period, unless otherwise required by law or App Store rules.
If we increase the price of a plan to which you are already subscribed, we will notify you in advance, within the timeframes and by the method provided for by Apple's rules and applicable law. If you do not agree to the price increase, you may cancel the subscription before it renews.
9. Your obligations and acceptable use
You agree to use Sintem only lawfully, in good faith, and within its intended purpose.
In particular, you are prohibited from:
- using Sintem for surveillance, stalking, harassment, threats, blackmail, discrimination, or other harm to other persons;
- inviting people into a group without their consent or without lawful grounds, especially if minors are involved;
- sharing invitations publicly or with strangers if you do not intend to provide them access to group data;
- attempting to obtain unauthorized access to Sintem accounts, groups, data, servers, or infrastructure;
- interfering with the operation of the service, overloading it, conducting reverse engineering, circumventing restrictions, using bots, scripts, or automated means, unless expressly permitted by us;
- uploading content that is illegal, offensive, misleading, or violates third-party rights, including avatars;
- using SOS, notifications, location sharing, or invitations for fraud or abuse;
- using Sintem in violation of applicable laws on data protection, privacy, geolocation, child protection, or other legal requirements.
You are responsible for complying with applicable law when using location, notification, and invitation features, including obtaining necessary consents from other persons when required by law.
10. User content
You may provide content through Sintem, such as display name, avatar, or other profile data.
You retain rights to your content, but grant us a non-exclusive, limited license to store, process, display, and transmit such content to the extent necessary for the operation of Sintem, compliance with these Terms, ensuring safety, and fulfilling legal obligations.
You confirm that you have all necessary rights to the content you upload or provide, and that such content does not violate third-party rights.
We may remove or restrict access to content if we have reasonable grounds to believe that it violates these Terms, the law, or the rights of other persons.
11. Third-party services
Sintem may use or link to third-party services and applications, including, but not limited to:
- Apple, including Sign in with Apple, App Store (including subscriptions), and push notifications;
- mapping and routing services such as Apple Maps or Google Maps;
- providers of cloud infrastructure, storage, notification delivery, and diagnostics.
Use of such services may be governed by separate terms and policies of the respective third parties. We do not control and are not responsible for the operation, availability, accuracy, content, or policies of such third-party services.
If you open a route or other action in an external application, further use of such application is governed by its own terms.
12. Intellectual property
Sintem, including the application, design, interface, software, logos, texts, graphics, and other service materials, belongs to us or our licensors and is protected by applicable intellectual property law.
We grant you a limited, non-exclusive, non-transferable, revocable license to use Sintem for personal non-commercial purposes in accordance with these Terms.
Without our prior written consent, you may not copy, modify, distribute, sell, rent, decompile, create derivative works, or otherwise use Sintem materials, except in cases expressly permitted by law.
13. Termination of access and account deletion
You may stop using Sintem at any time, including by deleting your account through the application.
We may suspend or terminate your access to Sintem in whole or in part if:
- you violate these Terms;
- this is necessary to protect users, the service, or investigate an incident;
- your account is used unlawfully or creates a risk to other persons;
- this is required by law or a justified request from a competent authority.
We may temporarily delay account deletion or certain actions with a group if strictly necessary during a limited period after SOS activation, to prevent abuse, protect the safety of members, investigate an incident, or fulfill legal obligations.
After account deletion or termination of access, certain provisions of these Terms that by their nature should survive continue to apply, including provisions on limitation of liability, disclaimer of warranties, intellectual property, dispute resolution, and applicable law.
The procedure for account deletion, the composition of personal data deleted, cases when certain data may be retained (including in backups), and retention periods are described in the Sintem Privacy Policy (section 12 "Account deletion" and section 6 "Data retention periods").
14. No professional advice
Sintem does not provide or replace medical, legal, or other professional advice. Application features and notifications, including SOS, location history, and alerts, are intended only for use within trusted groups and are not a recommendation on how to act in a specific situation.
How to respond to an SOS notification or other safety event is your decision and at your own risk. In case of a real threat to life, health, or property, contact competent emergency, medical, or law enforcement services directly, and do not rely solely on Sintem features.
15. Disclaimer of warranties
Sintem is provided on an "as is" and "as available" basis.
To the maximum extent permitted by applicable law, we make no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, continuity, error-free operation, security, timely delivery of notifications, availability of location, or conformity to your expectations.
We do not guarantee that:
- the application will operate without interruptions, errors, or delays;
- location will be accurate, up to date, or available at any moment;
- SOS or other notifications will be delivered and seen in a timely manner;
- group members will respond to SOS or other events;
- features available today will remain available in the future in the same form.
16. Limitation of liability
To the maximum extent permitted by applicable law, Tamerlan Sarakaev shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, or for loss of profit, data, business reputation, business opportunities, or other intangible losses arising from or in connection with the use or inability to use Sintem.
To the maximum extent permitted by applicable law, our aggregate liability for any claims arising from or related to Sintem or these Terms is limited to the greater of the amount actually paid by you to us for access to paid Sintem features during the six months preceding the event giving rise to the claim, and 100 US dollars, if paid features were not purchased or if a different amount is not required by applicable law.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for intentional breach, gross negligence, or other liability expressly prohibited from exclusion.
17. Indemnification
You agree to indemnify, defend, and hold harmless Tamerlan Sarakaev from any claims, demands, damages, expenses, and costs, including reasonable legal fees, arising from or related to:
- your use of Sintem;
- your content;
- your violation of these Terms;
- your violation of third-party rights or applicable law;
- inviting, adding, or supervising other users, if you are a group owner or authorized adult.
18. Changes to the service and Terms
We may change Sintem and these Terms from time to time.
If changes are material, we may notify you by email, through an in-app notification, or by other appropriate means. The updated version takes effect from the date specified in it, unless otherwise required by applicable law.
If you continue to use Sintem after the updated Terms take effect, this means your agreement to the updated version, unless applicable law requires otherwise. If an update requires separate acceptance, we may restrict access to certain features until such acceptance.
19. Governing law and disputes
These Terms are governed by the law of Georgia, without regard to conflict-of-law rules, unless otherwise required by mandatory norms of applicable consumer protection legislation.
If you are a consumer, you may have mandatory rights under the law of your country of residence that cannot be limited by these Terms.
Disputes arising from or in connection with these Terms or Sintem shall be subject to the jurisdiction of the courts of Georgia, unless otherwise required by mandatory norms of applicable law.
Before going to court, we recommend that you first contact us at support@sintem.net to attempt to resolve the matter in good faith.
20. Miscellaneous
20.1. Entire agreement
These Terms together with the Sintem Privacy Policy and other documents expressly referenced by the application constitute the entire agreement between you and us regarding use of Sintem, unless otherwise required by law.
20.2. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions remain in effect to the maximum extent permitted.
20.3. Waiver
Our failure to enforce any right or provision does not constitute a waiver of such right or provision in the future.
20.4. Assignment
You may not assign your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations in connection with a merger, sale, reorganization, or transfer of business, provided that these Terms or substantially similar terms are maintained.
20.5. Force majeure
We are not liable for failure or delay in performing obligations under these Terms if caused by circumstances beyond our reasonable control, including, but not limited to: failures or unavailability of infrastructure of Apple, the App Store, cloud service providers, push notification delivery, mapping services, or internet providers; natural disasters; actions of government authorities; power or communications failures; other extraordinary circumstances beyond our control.
During such circumstances, certain Sintem features, including location sharing, SOS notifications, and push notifications, may be temporarily unavailable or operate with delay. This does not cancel the limitations set out in sections 2 and 15.
20.6. Language
These Terms are drafted in English, which is the official version. If we publish translations into other languages, in case of discrepancies between translations, priority may be given to the English version, unless otherwise required by law.
